Terms of Service

These terms govern your use of Track My Build ("we", "us", "the Platform"), operated by Track My Build Ltd, a company registered in England & Wales under company number 17323741. By creating an account or funding a project you agree to these terms. If you do not agree, do not use the Platform.

1. What we do

Track My Build is a record-keeping platform for UK residential construction projects. It keeps the milestones, scope, variations, documents, evidence and approvals for a project together in one place, so that Customers (homeowners) and Builders (contractors) have a shared record of what was agreed, what was completed and what was approved.

We are not a party to the building contract between Customer and Builder, do not perform building work, and do not warrant the quality, timing, or legality of any work carried out. We are not a bank, are not authorised by the Financial Conduct Authority, and nothing on the Platform is covered by the Financial Services Compensation Scheme.

2. Eligibility & accounts

  • You must be 18+ and legally able to enter contracts in the UK.
  • You are responsible for keeping your login credentials secure and for all activity on your account.
  • Builders must complete identity and business verification before any future payout can be enabled.

3. Milestones and approvals

Funding a milestone charges the Customer’s card and the money is held by us as described in section 1. Releasing a milestone passes it to the Builder.

  • A milestone is only released following explicit Customer approval in the Platform.
  • Variations (unexpected costs) require Customer approval before the varied work is recorded as agreed.
  • No milestone is ever released automatically on a time-based schedule.
  • A Customer may request a refund of any funded milestone they have not yet approved. Once a milestone is approved the money has gone to the Builder and we cannot reverse it. Our Refund Policy sets out the full position, including disputed milestones.

4. Fees

The Platform is free for Customers. Track My Build may introduce Customer pricing in future and will publish it in updated terms, and give at least 30 days’ notice by email, before it applies. Builder subscriptions are priced on the number of active projects they run: £49.99 for one, £99.99 for up to four, £149.99 for unlimited, and £29.99 per additional active project. A Builder chooses their plan and sees the price before any card is charged, and may cancel at any time from the billing portal; cancellation takes effect at the end of the period already paid for. A project counts towards a Builder’s plan from the point the Builder accepts the invitation to that project, and stops counting once the project is completed and archived. Completion works as follows: a Builder may mark a project complete; the Customer then has five business days to object, and the project is archived when that period ends or when the Customer confirms completion, whichever is sooner. If the Customer objects within that period the project reopens. A Builder will never be removed from a live project because of their subscription status; where a Builder is over their plan limit they will retain full access to existing projects and will not be able to accept new ones until it is resolved. Track My Build takes no percentage of construction value. Track My Build Ltd is not currently registered for VAT, so no VAT is added to the prices above and they are the total payable. If it becomes registered, VAT will be added to subscription fees and Builders will be notified before it applies. This does not affect a Builder’s own VAT position on their work, which remains a matter between the Builder and the Customer.

Card processing. The payment provider charges a fee on every milestone a Customer funds. That fee is deducted from the amount passed to the Builder, so the Customer pays the milestone amount in full and the Builder receives that amount less the card cost. As a guide this is currently in the region of 1.5% plus 20p on a UK card, set by the payment provider and not by us. The exact figure for each milestone is shown on the Builder’s receipt. Track My Build keeps none of it.

5. Disputes

If Customer and Builder cannot agree on release of a milestone, the milestone remains unreleased. Either party may raise a dispute by contacting support@trackmybuild.co.uk. We will act as a neutral facilitator and may ask for documentation and photos before a milestone is marked released. Where a dispute cannot be resolved on the evidence submitted, we can arrange an inspection by an independent RICS-registered surveyor. This is an optional service, charged at cost, and both parties must agree before a surveyor is instructed. We do not adjudicate contractual disputes; unresolved disputes may need to be referred to a court or alternative dispute resolution provider.

6. Prohibited use

  • Money laundering, fraud, or funding non-construction activity.
  • Impersonating another person or business.
  • Uploading unlawful, defamatory, or infringing content.

7. Liability

To the fullest extent permitted by UK law, our liability is limited to the platform fees paid to us for the project in question. We are not liable for defective workmanship, project delays, or losses arising from a Builder's or Customer's actions. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be excluded.

8. Termination

You can close your account at any time. If we are holding any funded milestone that you have not approved, we will return it to the card it was paid from before the account is closed. Your project record will be handled in line with our Privacy Policy. We may suspend or close accounts that breach these terms or applicable law; where we do, any funded milestone you have not approved is returned to you.

9. Changes

We may update these terms from time to time. Material changes will be notified by email to your account address. Continued use of the Platform after changes take effect constitutes acceptance.

10. Governing law

These terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute arising from these terms or your use of the Platform.
