Terms of Service

These terms govern your use of Track My Build ("we", "us", "the Platform"), operated by Track My Build Ltd, a company registered in England & Wales. By creating an account or funding a project you agree to these terms. If you do not agree, do not use the Platform.

1. What we do

Track My Build is a milestone-based payment protection platform for UK residential construction projects. Homeowners ("Customers") deposit funds into a segregated client account. Funds are released to the contractor ("Builder") only when the Customer approves the associated milestone, or when both parties agree a variation.

We are a payments and payment protection facilitator. We are not a party to the building contract between Customer and Builder, do not perform building work, and do not warrant the quality, timing, or legality of any work carried out.

2. Eligibility & accounts

  • You must be 18+ and legally able to enter contracts in the UK.
  • You are responsible for keeping your login credentials secure and for all activity on your account.
  • Builders must complete Stripe KYC / KYB checks before receiving payouts.

3. Protected funds & milestone releases

  • Customer funds sit in a ring-fenced client account and are never mixed with company funds.
  • Releases require explicit Customer approval of the milestone in the Platform.
  • Variations (unexpected costs) require Customer approval AND a top-up deposit before work continues.
  • Refunds of un-released funds are returned to the Customer's original payment method within 5–10 business days.

4. Fees

Homeowners pay £0 to open, deposit and release milestones — the Platform is free for Customers. Builders choose between Standard (6% per released milestone) or Pro (£14.99/month, 4% per released milestone). Fees are a pure percentage of each milestone amount with no maximum cap. All fees are shown before confirming a deposit or release.

5. Disputes

If Customer and Builder cannot agree on release of a milestone, funds remain protected. Either party may raise a dispute by contacting support@trackmybuild.co.uk. We will act as a neutral facilitator and may require documentation, photos, or independent inspection reports before releasing funds. We do not adjudicate contractual disputes; unresolved disputes may need to be referred to a court or alternative dispute resolution provider.

6. Prohibited use

  • Money laundering, fraud, or funding non-construction activity.
  • Impersonating another person or business.
  • Uploading unlawful, defamatory, or infringing content.

7. Liability

To the fullest extent permitted by UK law, our liability is limited to the protection fees paid to us for the project in question. We are not liable for defective workmanship, project delays, or losses arising from a Builder's or Customer's actions. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be excluded.

8. Termination

You can close your account at any time. Any funds held in your protected account will be handled according to the release rules above. We may suspend or close accounts that breach these terms or applicable law.

9. Changes

We may update these terms from time to time. Material changes will be notified by email to your account address. Continued use of the Platform after changes take effect constitutes acceptance.

10. Governing law

These terms are governed by the laws of England & Wales. The courts of England & Wales have exclusive jurisdiction over any dispute arising from these terms or your use of the Platform.
